Terms & conditions

1. NO PURCHASE NECESSARY to enter the Promotion. Void where prohibited by law.
2. The Promotion is open to UK US and Canadian (excluding Quebec) residents aged 18 years and over.
3. Employees and their immediate family members and individuals living in the same household, of Promoter, its parent, subsidiaries, affiliated or related companies, including but not limited to Dorling Kindersley Ltd., Penguin Books Ltd., and Penguin Group (USA) Inc., and/or authors or the agencies of any of them are not eligible for this Promotion. Groups, clubs, organizations, commercial entities and businesses cannot participate.
4. All entries must be received by 28th Feb 2009 at 11:59 pm in the time-zone of the entrant’s jurisdiction (the “Closing Date”). The sole determinant of time for the purposes of receipt of a valid entry will be the computer server(s) of Promoter.
5. The Promoter accepts no responsibility for any entries that are incomplete, illegible, corrupted or fail to reach the Promoter by the relevant Closing Date for any reason. Proof of posting or sending is not proof of receipt. Entries via agents or third parties are invalid. Entries become the property of the Promoter and will not be returned.
6. Only one entry per person. No entrant may win more than one prize.
7. To enter, fill in your first name, surname, address and email and make your choice of one of the five (5) trip options on the online entry form found at www.traveldk.com/americas, then press “Enter”. If you are selected and confirmed as winner of the Grand Prize, you will have the option to change your selection and choose from any of the five (5) options.
8. All correctly completed eligible entries will be entered into the Promotion. A random drawing will be held on or around 1st March 2009. The odds of winning depend on the number of eligible entries received. All decisions of Promoter related to this Promotion are final and binding, without right of appeal.
9. There is one (1) grand prize and ten (10) second prizes available to be won.
   i. The Grand Prize is the winner’s choice of a seven (7) night Black Tomato adventure trip for two people, to be selected by the winner from five (5) prize trip options to one of the following locations: Brazil, Costa Rica, Ecuador, Nicaragua or Alaska, as specifically set forth at http://www.traveldk.com/americas. Regardless of the prize selected by the winner upon Promotion entry, the winner shall have the right to choose any prize from among the foregoing trips upon compliance with the provisions of the Paragraph 11 of these Terms and Conditions. The prize will include standard (economy) class air transportation from the major international airport nearest winner’s residence, at Black Tomato’s discretion, to the chosen destination, transfers from the destination airport and seven (7) nights accommodations for two (winner’s choice of twin, single or double room). All travel and tour arrangements must be made through Black Tomato and/or its appointed agent, and are subject to Promoter’s approval. Any expenses not specifically described as included in the Grand Prize are excluded. Without limiting the generality of the foregoing, the grand prize does not include: ground and air transportation and transfers in winner’s country of origin, including to and from the major international airport from which the winner departs, spending money, entrance fees, personal expenses, food and drink, travel and health insurance, gratuities, additional hotel expenses such as telephone calls, upgrades and incidentals, and all applicable taxes. All such expenses on receipt and use of the prize are the sole responsibility of the winner. Both the prize-winner and chosen companion must be 18 years or over, and must travel together. Winner and chosen companion are responsible for obtaining all necessary visas and valid passports for travel to the destination. The prize must be claimed within one year of the winner being notified. Travel insurance is not included in the prize but is a requirement of booking the holiday and must be obtained by the winner and travel companion prior to travel. Total approximate retail value of the prize is £5,000 based on sample London, England departure and USD $10,000 based on sample New York/Toronto departure. The Grand Prize, including travel dates and times, is subject to availability. The Grand Prize is not valid during weeks that include Christmas, Easter, New Year’s Day or any other public holidays that occur in accordance with the winner's jurisdiction of residence. The Grand Prize is non-transferable.
   ii. The second prize is a “goody bag” consisting of a copy of Americas: Where to Go When, a DK bag and a T-shirt. Total approximate retail value of each second prize is £32/USD$64.
10. In the event of unforeseen circumstances, the Promoter reserves the right (a) to substitute an alternative prize of equivalent or greater value, and (b) in exceptional circumstances, to amend or foreclose the Promotion without prior individual notice.
11. Selected entrant will be notified via email or post by 31st March 2009. To be confirmed a winner, the selected entrant must: (1) claim their prize within fourteen (14) business days of the Promoter sending notification; (2) sign and return an affidavit of eligibility and compliance with the Promotion’s Terms and Conditions, release of liability and consent to publicity (“Affidavit”); (3) obtain parental consent to accept the prize if the selected entrant is under the age of majority in his/her jurisdiction of residence; and (4) if the selected entrant is from Canada, correctly answer, without mechanical or other assistance, a time-limited mathematical skill-testing question to be administered by telephone. If a selected entrant is not confirmed a winner as described above, or if the prize is unclaimed after this time, the prize will lapse and the Promoter reserves the right to offer the unclaimed prize to a substitute selected entrant in accordance with these rules.
12. Winner’s travel companion (and his/her parent or guardian, if he/she is under the age of majority in his/her jurisdiction of residence) must sign and return a liability/publicity release form prior to commencement of travel.
13. To obtain the names of the winners, please email editor@traveldk.com stating the name of the Promotion in the subject heading four (4) weeks after the selection date of 1st March 2009 and before 1st September 2009.
14. The Promoter will use any data submitted by entrants for the purposes of running the Promotion, unless otherwise stated in the entry details. By entering this Promotion, all entrants consent to the use of their personal data by the Promoter for the purposes of the administration of this Promotion, which includes posting of winners’ names and cities of residence on Promoter’s website and any other purposes to which the entrant has consented.
15. The winners agree to take part in reasonable, post-event publicity and to the use of their names and photographs in such publicity.
16. By entering the Promotion each entrant agrees to abide by these terms and conditions, and the decisions of the Promoter, which shall be final and binding. The Promoter is Dorling Kindersley Limited, 80 Strand, London WC2R 0RL.
